2. Client Responsibilities & Compliance
You represent and warrant that:
You own or have lawful permission to use all contact data provided to us
You have obtained all legally required consents for calls, SMS, and emails
Your use of our services complies with all applicable laws, including TCPA, CAN-SPAM, and carrier requirements
You will not use our services for spam, scams, fraud, or unlawful activity
You are solely responsible for the content, legality, and consent associated with your communications.
3. A2P Messaging & TCPA Acknowledgment
KnightVision Marketing is A2P verified and operates in compliance with carrier standards. However:
We do not independently verify your consent records
You assume full responsibility for compliance related to your messaging campaigns
We are not liable for fines, penalties, or claims arising from your misuse
We reserve the right to suspend or terminate messaging services immediately if violations are suspected.
4. No Guarantee of Results or Delivery
We do not guarantee:
Message delivery or receipt
Carrier approval or uptime
Lead volume, conversions, sales, or business outcomes
Delivery and performance depend on third-party platforms, carriers, and market conditions beyond our control.
5. Third-Party Platforms
Our services rely on third-party tools and providers, including GoHighLevel and its integrated services. We are not responsible for:
Service outages
Platform changes
Carrier filtering or blocking
Third-party policy enforcement
Your use of these services is also subject to their respective terms.
6. Fees, Billing & Payments
Fees may be charged on a subscription, one-time, or custom basis as agreed. Failure to pay may result in:
Suspension of services
Termination of access
Loss of data or configurations
All fees are exclusive of taxes unless stated otherwise.
7. Refund Policy
All sales are final.
KnightVision Marketing does not offer refunds for services rendered, subscriptions, setup fees, or unused services.
8. Suspension & Termination
We may suspend or terminate your access immediately, with or without notice, for:
Non-payment

Abuse of services
Risk to compliance, carriers, or infrastructure
You may terminate services according to any written agreement in place, but fees already paid are non-refundable.

All website content, systems, workflows, and materials are the intellectual property of KnightVision Marketing unless otherwise stated. Unauthorized use is prohibited.
10. Limitation of Liability
To the maximum extent permitted by law, KnightVision Marketing shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption.
Our total liability shall not exceed the amount paid by you in the prior 30 days.
